Terms of Service

Kenect Networks – Terms of Service

Effective Date: December 29, 2024

Welcome to Kenect Networks. By accessing or using our services—including internet access, managed IT, firewall solutions, desktop support, and related offerings—you agree to these Terms of Service.

1. Services We Provide

Kenect Networks offers:

  • High-speed internet for homes and businesses

  • Managed firewall and network security

  • Desktop support and remote helpdesk

  • Laptop leasing and device provisioning

  • Wi-Fi design, setup, and monitoring

  • Additional IT services as agreed upon

Services may vary by location and availability.

2. Eligibility

You must be 18 years or older or a valid business entity to use our services. By signing up, you confirm you meet this requirement.

3. Service Availability

Services are delivered on a best-effort basis. Interruptions may occur due to third-party providers, equipment limits, or environmental factors.

Kenect Networks is not liable for outages caused by events outside its control, such as severe weather, upstream failures, or force majeure.

4. Customer Responsibilities

You agree to:

  • Use services legally and ethically

  • Prevent unauthorized access to your network

  • Notify us of significant technical or billing issues

  • Pay all fees on time according to your plan

You are responsible for any usage on your network, including by employees, tenants, or guests.

5. Fees and Billing

You agree to pay monthly service fees, equipment charges, and applicable taxes. Unless otherwise specified, invoices are issued monthly.

  • Grace Period: 10 days from invoice date

  • Late Fees: 5% of overdue balance may apply

  • Service Suspension: May occur after 10 days of nonpayment

  • Collections: Accounts in default may be referred to collections

6. Term and Termination

This agreement remains in effect until canceled by either party with 30 days' written notice. Early termination may incur fees.

We may suspend or terminate service for:

  • Nonpayment

  • Abuse or fraud

  • Security violations

  • Breach of these terms

7. Acceptable Use Policy (AUP)

You may not:

  • Send spam or distribute malware

  • Launch DDoS or hacking attempts

  • Violate intellectual property laws

  • Resell or redistribute service without approval

Violations may lead to suspension or termination.

8. Equipment

All hardware leased or provided by Kenect Networks remains our property. It must be returned within 14 days after service ends or replacement fees may apply.

9. Privacy and Data

We do not monitor your online activity beyond what is necessary for billing, diagnostics, or legal compliance.

10. Service Level Agreement (SLA)

Kenect Networks provides best-effort services under the following SLA terms:

  • Uptime Target: 97% per calendar month

  • Service Credits: Only offered for outages longer than 48 hours, caused solely by Kenect

  • Maintenance: Scheduled maintenance does not count as downtime

  • Response Time:

    • Critical Issues: 8 business hours

    • Standard Issues: 1–2 business days

  • Exclusions: SLA does not apply to:

    • Force majeure events

    • Client-side equipment failures

    • Upstream provider outages

All SLA credits are issued at our sole discretion and must be requested within 5 business days of the outage.

11. Limitation of Liability

We are not liable for:

  • Indirect, incidental, or consequential losses

  • Lost profits, data, or business opportunities

  • Events caused by third parties or external networks

Our liability is capped at the total fees paid by you in the last 30 days.

12. Indemnification

You agree to defend and indemnify Kenect Networks against any claims, damages, or legal expenses arising from your use of our services or violation of these terms.

13. Changes to These Terms

We may update these terms from time to time. You will be notified of any material changes at least 15 days in advance. Continued use means you accept the updates.
